If this trial does rule in favor or not of repealing Prop. 8, then the higher-up judges do have a precedent to control if the proposition is being challenged in the same manner as Baker vs. Nelson (Which it is now). And the Baker vs. Nelson case has been used by courts in other states to show that denying marriage to gay-couples is not discriminatory (Under the 14th Amendent). And the ruling judges commented that marriage is for procreation, a stab in a common gay-marriage arguement. It also found that there is a difference between letting different races marry and letting same-genders marry (in relation to procreation).
I do love deflating bubbles, and Covet's bubble will probably be deflated. The judge for this trial is conservative, and while I wish for judges to hold neutral-views (Unlike some liberals I know. =P), he may rule in favor of keeping Prop. 8 legit.

It's the case of Baker vs. Nelson, a homosexual couple who were denied a marriage license, and sued as it "violated the Constitiution," well it got to the Supreme Court, who dismissed it, but it does serve as a legally binding precendent (in favor of denying marriage licenses to gay couples).
