For all intents it’s like the Nebby situation till Mallow catches it in a Pokeball. (And if that happens it might be a repeat of Poipole.)

Litten wasn't staying with with the lady.By your logic it can be easily argued that the recurring old lady owned Litten before Ash came along, and that Ash owned Nebby.
We will see...The ownership of a Pokemon requires the bare minimum of a Pokeball and that has never been disputed in the 20 year run of the franchise. We know for a fact that Shaymin doesn’t have a Pokeball so it isn’t caught.
