Sort of. It's non-observation plus experimentation. By putting the poison in, you have a 50/50 chance on the cats fate (Dead or alive). The fate is ONLY determined when you open the box though.
As how can you know for SURE the cat is alive or dead unless you open the box?
That's observation, of auditory sense. If you have a sealed box and don't do anything to it.......the cat is both alive and dead until you make an observation. <.< In your case, shaking the box.
