Not sure that that's a valid argument, considering that we've seen trainers that have caught Legendaries before.
Still, glad that she doesn't catch Kyogre, since that would've been pretty stupid, with the current overflow of special Pokémon and what not.
Not to mention that the Groudon fossil from the Jirachi movie proves that there's more than one Groudon. And if that's the case for Groudon, than the same must be true for Kyogre.
